What is the deadline for submitting applications of political parties, independent candidates, citizens' associations and groups of 40 citizens to participate in the 2020 Local Elections?

In accordance with the Instruction on deadlines and sequence of electoral activities for the 2020 Local Elections, deadline for submission of applications by political parties, independent candidates, citizens' associations and groups of 40 citizens is July 3, 2020 by 16:00 hours.

How is the application submitted electronically?

A political subject may submit an application to participate in the 2020 Local Elections, including all attachments, to the Central Election Commission of BiH electronically as well, to e-mail politicki.subjekti@izbori.ba.

In case of submitting the application by e-mail, the political subject must submit the complete original documentation to the address of the Central Election Commission of BiH by registered mail no later than July 3, 2020.

What documentation does a political party submit to participate in the elections?

2. Excerpt from the entry in the court register not older than 60 days and a certified copy of the decision on entry in the court register

How many voters' signatures of support do political parties and independent candidates need to collect to participate in the elections?

For municipalities / cities with more than 10.000 voters, at least 200 valid signatures of support must be submitted.

For municipalities / cities with less than 10.000 voters, at least 100 valid signatures of support must be submitted.

For municipalities with less than 1.000 voters, 5% of the total number of voters is submitted.

Example 1: Number of voters in the municipality, according to the Decision on concluding the Central Voters' Register on the day May 6, 2020 at midnight is 560 voters, so both a political party and an independent candidate for that municipality submit at least 28 valid signatures of support (560 x 5% = 28).

In which cases does a political subject have no obligation to collect signatures of support?

Political party and independent candidate who won a mandate at the 2016 Local Elections (mandate of councilor or municipal/city) are exempted from the obligation to collect signatures of support in the municipality / city in which they have a mandate (for councilors, as well as for municipal/city mayor).

Also, a political party or independent candidate who won a mandate as a member of a coalition, i.e. list of independent candidates at the 2016 Local Election, have no obligation to collect signatures of support.

The won mandate is valued in accordance with the Decision on confirming the results of the 2016 Local Elections.

Are the forms for collection of signatures of support take exclusively at the seat of the BiH CEC or are they also available electronically?

Forms for collection of signatures of support are pre-printed and they can be only taken at the seat of the BiH CEC where serial numbers of the forms are recorded.

Are signatures of support for the same municipality / city collected separately if the political party wants to participate in the elections for both the mayor and the municipal/city council/assembly?

It is not necessary to collect signatures separately for the mayor and for municipal/city council/assembly if it is the same municipality/city.

Does the voter giving the signature of support have to be registered in the Central Voters' Register in the municipality / city for which political subject is collecting signatures of support?

Yes, voters give signature of support to the political subject to run for the municipality / city where the voters are registered in the Central Voters' Register.

Is the political subject exempted from collecting signatures of support if it has a mandate at a higher level authority (in the Cantonal Assembly, the RS National Assembly, the FBiH Parliament, and the Parliamentary Assembly of BiH)?

A political subject is not exempted from the obligation to collect signatures of support if it has a mandate at a higher level because these are different election cycles.

What is the amount of the tax for participation in the elections for a political party and an independent candidate?

In accordance with the Decision on the amount of the tax for participation in the Local Elections 2020, the tax for participation in the elections for an independent candidate is 1.000 KM.

The amount of tax for a political party:

-          1.000 KM is paid for participation in the elections for municipal/city council/assembly at the seat of the political party, and 100 KM for every subsequent municipal/city council/assembly.

-          1.000 KM for elections for municipal/city mayor is paid for the seat of a political party and 100 KM for each subsequent candidacy for city/municipal mayor.

Do political subjects pay the tax and submit signatures of support for the election of representatives of national minorities?

If political subjects only stand in the election for representatives of national minorities, they are not obliged to the certification tax or collect signatures of support.

Where can the statement on acceptance of the candidacy and the declaration of affiliation to the constituent people/group/others/national minorities be verified?

In addition to verifying the signature in the manner prescribed by law the statement may also be certified by the competent municipal / city election commission.

Can a civil servant be a candidate in an election?

Civil servants, as well as other office holders referred to in Article 1.8 paragraph (1) of the Election Law of BiH, may run for public office only if they have previously resigned from that position or acted in accordance with the laws governing their status. A statement confirming the aforementioned status is signed and certified, and submitted with the application to participate in the elections.
